Privacy statement

Boels respects the privacy of all users of its website and its services and treats all information and personal data confidentially. In this statement you can read how we handle the personal data in question and for what purposes we process it.

1. Who is responsible for personal data?

This privacy statement applies to the processing of personal data by Boels Topholding BV and its affiliated companies (hereinafter 'Boels'). Boels is responsible for processing the personal data. We do not sell your personal data to third parties. There is a supplementary privacy statement for some of our services. In the supplementary privacy Statement we explain how we handle your personal data with that service. A supplementary privacy statement or explanation is a supplement to this privacy statement.

2. For which purpose do we process your personal data?

Boels processes your personal data for several purposes. These are:

  • to enter into a relationship with you by means of an agreement;
  • to execute the obligations as described in an agreement with you;
  • to develop and improve our business activities;
  • for the purpose of relationship-management and promotional and marketing purposes;
  • to execute business processes and prepare internal and external reports.

3. Which legal base can be used to process your personal data?

In order to provide you with services in the field of equipment rental and sales of equipment, processing your personal data is necessary. We may only process your personal data if there is a good reason for doing so: a legal basis. The legal bases we use are:

  • The processing of personal data is necessary to be able to enter into and execute an agreement with you;
  • The processing of personal data is necessary for Boels to be able to comply with a legal obligation;
  • The processing of personal data is necessary because Boels has a legitimate interest in doing so and this legitimate interest outweighs your right to privacy; and
  • Processing of personal data is permitted because you have given permission to process your personal data. Permission you have given yourself can always be withdrawn.

4. Which personal data do we process?

4.1 Personal data

Examples of this type of data?
Name, address, telephone number and e-mail address.

For which purpose do we process your personal data?
To fully execute our agreement with you, or with the third party from which you have rented or purchased equipment (e.g. placing orders, returning goods, rectifying problems during rental), to procure services or goods from you and/or to be able to send you service e-mails, satisfaction surveys, newsletters and (personalised) offers.

4.2 Payment and transaction data

Examples of this type of data?
Bank account number, account holder, transaction details of transactions with Boels (e.g. order history, contracts and invoices) and direct debit authorisations.

For which purpose do we process your personal data?
To pay an invoice to you, to send you an invoice and to collect payment of an invoice send to you.

4.3 Data that says something about the use of our websites, related applications and e-mails

Examples of this type of data?
- Cookies,
- IP address,
- web pages visited,
- location data and data about the device via which you use our websites. applications and/or

For which purpose do we process your personal data?
- To track your internet behaviour on our website and applications.
- To be able to ensure our website and app work properly and securely for you.
- To offer personalised messages, advertisements or banners.
- To improve the website and app through the use of analytical cookies.

4.4 Data that says something about the use of our rental services

Examples of this type of data?
The nature and number of rented products, geolocation, emission of substances, duration of use, maintenance and other data related to the use of rented products.

For which purpose do we process your personal data?
To prevent (the risk of) improper use, theft, embezzlement or other possible criminal offences, to offer you insight and overview into your rented products and user data, to be able to comply with (financial and environmental) reporting requirements and to analyse and improve our services. Posting blogs with customer user experiences is also possible.

4.5 Data associated with a user account

Examples of this type of data?
Username and password.

For which purpose do we process your personal data?
To allow you to make use of a personal, secure environment on one or more of Boels' websites and/or related applications.

4.6 If you apply for a position with us: data associated with a job application

Examples of this type of data?
Name, address, age, telephone number, e-mail address, curriculum vitae and cover letter, the results of any assessment, references, public information like information on a LinkedIn profile and any other documents you send us.

For which purpose do we process your personal data?
To recruit, select new employees and (possibly) conclude an employment contract with them and to maintain contact with those involved about this. In some cases, we seek the data subject's permission to retain personal data longer with a view to any envisaged promotion to other positions.

5. How do we obtain your personal data?

When you leave your personal data on our website to make a reservation, use our services or give us permission to send you our newsletter, the personal data may be stored by us.

We may also receive your personal data from group units within Boels, for example for internal administrative purposes, such as improving our services.

Finally, we may also receive personal data from suppliers or other parties with whom we collaborate, for example if we receive user data from rented machines using hardware and software from suppliers, or when you consent to your payment being processed by direct debit.

6. Do we give your data to third parties?

Your personal data may be exchanged between and/or otherwise processed by the various Boels group entities. For example, because you ask us to do so, or because you also rent or purchase a product from another entity of Boels and we therefore do not have to receive your personal data more than once. This may be the case, for example, if you rent or buy from Boels in different countries.

We may also pass on your personal data to parties that provide services to Boels. The partners we regularly use to help us deliver our services are:

  • the partners we work with in the context of websites and related applications and from which we buy certain IT services (e.g. MyBoels);
  • transport and delivery partners (e.g. to deliver rented machines to you or collect them from you);
  • partners from which you rent equipment and that directly or indirectly rent products from us (e.g. DIY stores);
  • partners that provide payment services (e.g. handling authorisations for direct debit payments).

Sometimes we engage third parties as processors. These third parties then process personal data on our behalf. We only do this if we consider such a party to be sufficiently reliable and if this fits the purpose for which we have processed your personal data. In that case, we make agreements with these third parties that for example include clauses with regards to the way in which the personal data must be stored and secured.

Finally, we may also disclose data to parties to which we may be legally obliged to provide data (e.g. the police, tax authorities and/or supervisory authorities).

We do not disclose your personal data to third parties, with the exception of group entities, the parties necessary to provide you with services and parties to which we may be legally obliged to provide data. However, we may disclose your personal data if you have given us consent to share it with third parties.

If we transfer your data to other parties outside the European Economic Area (EEA), we take extra measures to protect your data. There must be an adequate level of protection in the country concerned and/or appropriate measures must have been taken to securely process personal data. In this situation, we use the contractual arrangements approved by the European Commission and take additional measures if necessary.

7. How long will your data be retained?

We do not retain personal data any longer than necessary for the purposes for which we have collected the personal data. In most cases, we retain personal data in line with the statutory retention periods. In some situations, we may retain data longer if this is needed, for example in case of a complaint or legal proceedings. If we no longer need the personal data for the purposes described in this privacy statement, we may still retain it for archiving purposes. In such a case, the personal data will only be used in legal proceedings or for statistical purposes.

If we process your personal data for recruitment and selection purposes and your application procedure does not lead to the conclusion of an employment contract or similar agreement, your personal data will be retained for up to 4 weeks after the end of the application procedure. If you have given us permission to store your personal data for a longer period, they will be kept for a maximum of 1 year after the end of the application procedure.

8. What are your rights?

In the context of the processing of your personal data, you have the following rights:

  • Right to information: With this privacy statement we inform you about what we do with your personal data. If necessary, we will provide you with additional information. For example, in a supplementary privacy statement or another method chosen by us.
  • Right to inspection: You can request us whether and which personal data we process from you. If so, we can give you access to the personal data we have processed from you.
  • Right to rectification: You can request us to correct or supplement the personal data we process about you if it is incorrect or incomplete.
  • Right to withdraw your consent: You can always easily withdraw your consent of the processing of personal data.
  • Right to object: You can object to the processing of your personal data for a specific purpose. We will then make a new assessment to determine whether your personal data may indeed no longer be used for the purpose in question.
  • Right to deletion: You can request us to delete your personal data. We are not always obliged to cooperate, for example if we are legally obliged to retain certain data.
  • Right to data portability: You can ask us to transfer your personal data to you or to another party. In the case of the latter, we will only comply with this request if it is technically possible.
  • Right to restrict processing: You can request to temporarily limit the processing of your personal data, which means that we process less personal data from you. We are not always obliged to cooperate, for example if we are legally obliged to store certain personal data.

If you wish to exercise one of these rights, we may ask you to identify yourself. We request data from you to ensure that you are the correct person to whom the personal data belongs.

We aim to comply with or respond to any request within one month. However, this period may be extended by two months for reasons related to specific privacy rights or the complexity of the request. If we extend this period, we will inform you of this in the first month. Sometimes the outcome of the request can be that we cannot comply with your request, for example if this would harm the rights of others, we would not comply with laws and regulations or if Boels' interest in processing the personal data outweighs your interest. If you wish to exercise one of your rights, you can make this known by contacting us via the contact details at the bottom of this privacy statement.

9. How is your personal data protected?

Boels uses both technical and organizational measures to protect personal data, such as encrypting sensitive information, applying access security to our locations and authorizations for limited groups of employees. All employees are subject to a duty of confidentiality. We continuously improve our security measures in the event of technological progress and developments.

The Boels websites may offer you the option to click through to other websites that are not affiliated with Boels. Boels has no control over the content or other characteristics of these websites and is not responsible for the processing of your data on these websites.

10. Does Boels make automatic decisions about me?

Boels does not use fully automatic decisions (including profiling), i.e. decisions made solely by computers without human intervention.

11. Data protection officer

We have appointed a data protection officer. This person is responsible for checking the correct handling of data and personal data of you and other stakeholders. Furthermore, the data protection officer monitors compliance with privacy legislation. Our data protection officer can be reached by e-mail at privacy@boels.com.

12. Filing a complaint

If you have any questions or would like to file a complaint about the use of your personal data, please contact us using the contact details at the bottom of this privacy statement. We will handle every question and complaint internally and communicate this further with you. If you believe that we are not helping you in the right way, you can contact the Dutch Data Protection Authority or national supervisory authority to file a complaint.

13. Changes to the privacy statement

Boels may unilaterally amend this privacy statement periodically, for example if other data processing is carried out and it is important for you to take note of this. Amendments will be published on our website. Therefore it is important to read this privacy statement regularly so that you are aware of any amendments.
